Terms of Service

These Terms of Service (“Terms”) govern your use of the Floraly mobile app and floraly.co (the “Service”). By using the Service, you agree to these Terms. If you do not agree, please don’t use the Service.

1. Who can use Floraly

You must be at least 13 years old to use the Service. If you use it on behalf of someone else, you confirm you’re authorized to accept these Terms for them.

2. Your account

You can use Floraly as a guest or create an account using email, Apple, or Google. You’re responsible for activity under your account and for keeping your login secure. Don’t use someone else’s account without permission.

3. License to use the app

We grant you a personal, non-exclusive, non-transferable, revocable license to use Floraly for your own personal, non-commercial use, subject to these Terms. You may not copy, modify, reverse-engineer, resell, or distribute the app except as allowed by law.

4. Your content

You keep ownership of the photos and information you add (“Your Content”). You grant us a limited license to store and process Your Content solely to provide the Service — for example, sending a photo for identification and saving your garden. You’re responsible for having the right to upload what you submit.

5. Acceptable use

Don’t use the Service to upload unlawful content, infringe others’ rights, attempt to disrupt or reverse-engineer the Service, or misuse it in a way that harms others or us. We may suspend or terminate access for violations.

6. AI guidance — no warranty

Plant identifications and care recommendations are generated using AI and may be inaccurate or incomplete. Some plants are toxic to people or pets. The Service is provided for general informational purposes only and is not professional horticultural, medical, or veterinary advice. Always verify before acting, and consult a professional when it matters. The Service is provided “as is” and “as available” without warranties of any kind, to the fullest extent permitted by law.

7. Limitation of liability

To the maximum extent permitted by law, Floraly and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss arising from your reliance on identifications, care guidance, or other content from the Service, including harm to plants, people, or pets.

8. Third-party services

The Service relies on third parties (including OpenAI, Supabase, Apple, and Google). Your use may also be subject to their terms. We’re not responsible for third-party services we don’t control.

9. Changes to the Service or Terms

We may update the Service or these Terms from time to time. If we make material changes, we’ll update the “Last updated” date above. Continuing to use the Service after changes means you accept the updated Terms.

10. Termination

You may stop using the Service at any time and delete your data from within the app. We may suspend or end access if you violate these Terms or to protect the Service.
